from what I understand there cannot be an All out ban due to the Supreme courts decisions within the Heller case. It was stated in the comments that the government can NOT restrict or prohibit firearms that are currently in use of Armies around the world. The right of the unorganized militia cannot be overthrown as it is the holy writ of the Bill of rights. Now a Constitutional convention COULD be called to strike down the amendments, however it would take a massive occasion for that to occur and to have it passed.

Looks to me like Heller is pretty clear, but the scope is narrow; that is, it is limited to the District. Yes, that is precedent any other court can use, but What makes me sweat is that different interpretations and wordings in different jurisdictions could have you in the greybar hotel along with the confiscation. Confiscation would put you out the money at least until your case was heard, and depending on the court's views at the time, the precedent could be affirmed or denied as applicable in your court's area. As seen with Katrina, there is some doubt in my MT head that your guns would come home in the same condition as when they got taken. Note that there is a hard road making a case that 20 or 30 guns are necessary for defensive purposes at home. The "hobbyist" could be out of luck.

My personal belief is that they will shift their focus from "firearms" to just ammo taxes, ammo restriction and parts restriction. Won't be a lot of stocking up or shooting when ammo is 10 bucks a round DC also has registered ammo law, if you are caught with unregistered ammo, the penalty is almost the same as having an unregistered handgun. He doesn't "Get" to necessarily replace any of them he gets to appoint new Judges as there becomes a vacancy "By retirement or death" or that is how it is suppose to work . Was reading some history and around 1930 there was at one time 15 Supremes . The President intentionally "Flooded" the court with left wingers so his New Deal wasn't overturned . I suppose Obama could do the same thing again .
Right, however The law was just nationally Incorporated, allowing certain districts about the United states AND her holdings to be subject to bullet proof lawsuits recently filed by Pro-Firearm groups. The lawsuits must fall to the Pro-2nds because of the decision by the Supreme courts. Also yes, if Obama can get some of the judges to retire or the other thing, then he can replace them with his own appointees. It might only take one or two because of how close things got with this argument. However there must also be another lawsuit brought up to challenge their previous findings (I am sure that it would not be hard to get). All in all I am not afraid of him with his challenges towards the second. This Heller decision came just at the right time to be a boon to our rights.
All O has to do is cross out the word “not” form the 2<SUP>nd</SUP> and he has got us. The Governor of IN. did the same thing here so now we can not have a civilian militia. He just crossed out the civilian militia part and wrote in “department of homeland security” and that was the end of the civilian militia or so they say. If they can do it here they can do it in D.C. After he gets in office it will read “The people’s right to bear arms shall be infringed”
