Federal judge rules Oregon's new gun safety law Measure 114 is constitutional

It is not over, the appeals will continue.


PORTLAND, Ore. — A federal judge found Oregon’s new gun control law is constitutional, saying Measure 114 aligns with other U.S. restrictions “regulating uniquely dangerous features” of guns to “protect public safety.”

The gun safety law, narrowly approved by voters in November 2022, established permit-to-purchase rules and a ban on the sale and transfer of high-capacity magazines.

U.S. District Judge Karin J. Immergut released her decision Friday (posted in full below) on a challenge to the measure that claimed the measure violated the Second Amendment.

Despite Judge Immergut’s ruling, Measure 114 remains on hold over a state court order out of Harney County.

On June 7, 2018, President Donald Trump announced his intent to nominate Immergut to serve as a United States district judge for the United States District Court for the District of Oregon.[9] On June 11, 2018, her nomination was sent to the Senate. President Trump nominated Immergut to the seat vacated by Judge Anna J. Brown, who assumed senior status on July 27, 2017.[10] On October 24, 2018, a hearing on her nomination was held before the Senate Judiciary Committee.[11]

On January 3, 2019, her nomination was returned to the President under Rule XXXI, Paragraph 6 of the United States Senate. On January 23, 2019, President Trump announced his intent to renominate Immergut for a federal judgeship.[12] Her nomination was sent to the Senate later that day.[13] On February 7, 2019, her nomination was reported out of committee by a 20–2 vote.[14] On July 31, 2019, the Senate confirmed her nomination by voice vote. She received her judicial commission on August 5, 2019.[

We all knew it his would be the outcome, and as much as Keven Starrette should STFU and never speak in public EVER, this was the expected outcome regardless.

We still have the State Court TRO and upcoming full trial in Harney County, so the State is still unable to claim any sort of victory here, and I expect we will now have Judge Benita's rulling to the 9th after being GVR'ed from SCOTUS basically telling the nutty ninth to STFU and follow the rulings of SCOTUS and rule correctly or else! Once his ruling is in, the States will be in a very bad place, and the 9th has two choices, rule correctly after their spankings, or defy SCOTUS again and suffer the consequences, which they have a LONG history of, being the single most corrupt and overturned count in the nation. This is where we still have hope, it looks like the state Judge has a proper understanding of all of this, and his ruling in September will in all likelihood stand as it is, and we get a full injunction if not an outright Vacate order from him! At that point ether the Oregon Supreme court steps in and reverses his ruling, or the Ninth takes a swing, but I don't see ether doing that! It's very much a wait as fast as we can and see, but for now, our rights are still intact, and will likely remain so through all of this!

 

Needs to go to SCOTUS before they pack the court or several of the originalist Justices have "accidents" or die from "natural causes" with a pillow over their face.

U.S. Sen. John Kennedy, R-La., repeatedly stumped one of President Donald Trump’s judicial picks with basic legal questions during the nominee’s confirmation hearing. That does not bode well for the nominee, Matthew Petersen, whom the president wants to put on the U.S. District Court of the District of Columbia.

 

Even the 9th circuit is expected strike it down killing all mag bans for the entire left coast.

 

She intentionally mangled Bruen to give a pre planned judgement. She also gave less weight to the plaintiff's testimony and evidence. A good breakdown here from Washington Gun Law

 

Now why would you expect a judge to read and review a case that was ruled against their personal beliefs?

 

Basically everything she wrote is wrong and surely will get struck down!

 

As long as the Soros check clears she won't care.

 

I wonder is the 9th won't just send it back to Immergut like they did with Benitez in MIller vs Bonta. If it gets to SCOTUS somebody will get a spankin'.
