It is not as bad as it started out but still bad enough and virtually every aspect of it already ruled unconstitutional by the SCOTUS. They shortened the banned gun list quite a bit. Replaced illegal to posses a already owned banned gun with Must Register it will the State Police. Will allow gun shops to sell existing stock or return to the manufacturer. Removed the 21 years old to own a firearm. Kept the ban on .50Cal ammo and firearms in. Raised the magazine maximum capacity from 10 to 12. Reduced the prison time and fines a bit for non compliance. Expands background checks. Makes the Red Flag laws stricter and easier to remove guns from those reported under the Red Flag Law and increases the time those reported must wait to possibly have their guns maybe returned if found not to be a danger to themselves or others. The NRA and IL Rifle Association vow to start the court filings as soon as Governor Prickster signs it into law. Illinois House OKs semiautomatic weapons ban, on to Senate
#1 Don't register any guns that you don't have to! #2 Buy your restricted ammo and magazines out of state! #3 Always have a few guns and some ammo hidden where only YOU can find them! #4 Thank GOD for the TRUMP SCOTUS and all of the other Federal judges appointed by President Trump (I still love the sound of that)! #5 Thank GOD for the NRA, GOA, IL Rifle Association, etc. It may take some time to work its way through the court system, but this will not stand!
In the long run it could work out good. By including FOID enhancements in the bill they very well may have opened the door to the SCOTUS to VOID The FOID.
But didn't Illinois pull a back door sneaky on this one. The law came as an amendment to some law about roller coasters?
Oh the NRA is going to actually do something? That's the most surprising part about the whole story. The only reason they care is even the dumbed down version still bans a lot of fudd guns.
Nope but kind of this is a stand alone bill that specifically bans or restricts guns and rights. Only thing left before it gets to the Governor and signed into law is procedural stuff between the house and senate. IL Rifle Association will be the primary player in the challenges.
SCOTUS will indeed void it. The thing will be if they then show SCOTUS their backsides and do it anyway...then the fun begins.
I will neither confirm or deny. Prickster did sign the bill into law a couple of hours ago to take effect immediately. It used to be I got up in the morning, lived my life all day long and went to bed that night a law abiding Citizen. Then at some point I woke up in the morning and broke at least 4 federal laws and 10 State laws before finishing breakfast. I have not changed, the laws that make law abiding Citizens in to criminals sure have.
I wouldn't worry too much about this so called 'law' because it is an unjust law and will be corrected shortly, as soon as put before a high court. Seems New York and Illinois are determined to test SCOTUS and I am sort waiting in apprehension to see them get kicked in the a$$...which brings up a really interesting scenario. The Legislative branch makes the laws, the Judicial branch interprets the law and the Presidential enforces the law....so what if they ignore SCOTUS? There is no one to enforce the law as Biden won't, certainly not against his beloved, heavy-hitting, Democrat states. Hmm...maybe they won't get kicked in the butt?
That old saying "when guns are outlawed only outlaws will have guns" was never really understood by most folks, but then most folks are useless mouth breathing idiots! However, plenty of foolish law-abiding gun owners will register their guns with the state police!
If a State goes against a Declared UnConstitutional Law and tries to enforce it, the defendent’s LawDawg can go to Federal District Court and get.a Writ of Habious Corpus, and the have that served on the Offending Officials by that Court’s US Marshal… and he has the Arrest Power to put those Offending Politicos in the local Jail for violating the Federal Court…
Oh yeah, like that is going to happen in this environment. Dream on. We have learned that what was once legal and correct no longer matters in this country. Even the FBI no longer can be trusted to follow the Rule of Law and certainly not the Justice Department. The upper echelons constantly break the law all the time and suffer no consequences. Hell, the sitting President in a video admitted he withheld a government loan to the Ukraine until they fired a prosecutor (think attorney general) that he didn't like which itself is an illegal act under US law never mind the persecutor happened to be investigating a company for corruption which his son was on its executive staff. I could give a dozen a examples like this! So, Rule of Law has very, very little meaning anymore...unless you are the general public then you are prosecuted to the fullest extent for even jaywalking. So, I won't hold my breath waiting for any US Marshals or the FBI to do the legal and right thing.
Another test case for the SCOTUS, and if they don’t want to be spending all of their time reviewing the same case law, they had better affirm the 2A the law of the land and be done with it !
