Need some advice...thinking about purchasing an AR Upper...

    I have been waiting 6+ months for Primary Arms Systems (PWS) to get their act together and start producing again. Finally, they got a limited amount of AR Pistols and some 12-inch Uppers available so... So, I am considering purchasing a Pistol and a short Upper (12-inch) for my use on PWS MK116, which is a 16-inch barrel, someday. I don't want to put any SBR ATF paperwork at this time, maybe someday, but not now so it will sit in my gun safe alongside my other guns until such a time that I want to use it and then I will submit paperwork.

    Questions:
    1. Am I wrong in thinking this is completely legal to purchase a short barreled Upper but not use it or will I be visited by some Federal Agents?

    2. What is everyone's opinion on the AR Pistol rework, will all AR Pistols become SBR and force people to submit paperwork or become felons? My understanding is it goes into effect August but no one is talking about it much...but it is still on-going.

    EDIT: OH! I read that the House just passed AR Weapons ban and now it goes to the Senate. Comments?

    No don't buy one. Buy 2.
    Constructive possession is say you only had one AR15 rifle receiver and that 12 inch upper was the only barrel you had for it and assuming you didn't own any other proper AR pistols.
    So as long as you don't have rifle receivers sitting around with no other 16+ barrels to go on them you should be good to go.
    If you have an AR pistol then get 2 or 5 different pistol barrels for it.

    At least 80% of AR pistol owners are going to ignore the new AR pistol rules because they bought one, from a normal gun shop, don't really follow gun law drama and have no idea how treacherous the ATF is or what they are doing trying to make legal gun owners into criminals.

    I can barely stand 16 carbines. I wouldn't want to be anywhere near a 12'' going off.

    Your in the right track, the pistol upper is perfectly legal to have, no paper work required!
    I run an 11.5 inch carry handle upper SBR, but it could easily be a pistol, that's the minimum barrel length needed before you really start loosing velocity, which sucks!
    Note, you will need a Carbine (Shorty) buffer, spring, and tube on your lower, otherwise your gonna have issues!

    Don't worry about a new AWB, and don't worry about the ATF ether, both will be powerless soon enough! Even if the ATF survives, their teeth will be yanked!

    The NFA will likely get shut down, and the flood gates opened to stuff currently regulated! Just hang on Brudda, the pain will be over soon!

    The AWB will never pass, not enough votes to make it, and even if it did, it would be challenged instantly and put on hold until SCOTUS shuts the door on that horseshit for good!

    Bad idea, ATF has been noted doing Warrantless Searches of regular Gun Owners, recently.. and in the company of local LEOs… If ATF comes to your door, politely ask to see a Warrant, and if they do not have one, tell them to “Please get off my Property, NOW”, and call the local Cops to come enforce your property Rights against Trespassers..

    I know they are much louder, and this might indeed force me to submit paperwork for a Suppressor.

    Yeah, I did the research and came up with that also.

    I have considered this, especially since the Feds seem to have it in for North Idaho folks since Ruby Ridge, seems they think we're all insurrectionists...maybe they're right. LOL! Obviously, I wouldn't want them to show up at my doorstep, not because I wouldn't be in the right to deny them entry but because once you get on their radar - well - they will find something on you or get the IRS to audit you or etc. You're screwed even if you are in the right and the only way to get them off is to beat them in court...then they will run you out of money fighting them.

    Giving this some more thought...I don't think I will purchase the Upper because what would I do with my 16-inch one, seems sort of pointless not having it on something. Instead, I might buy two AR Pistols which will force me to sell a couple of my ARs to make room in the safe...and to sooth my wife's temper. LOL!

    However, I am not convinced that the ATF won't enforce the AR Pistol being changed to SBRs requiring paperwork starting August, especially given the Biden/Harris administration. I think they will and if you ignore it...God help you if somehow you get caught. I mean, the regulation is out there and approved and becomes effective 1 August if I remember correctly.

    Ura-Ki, Well, I hope you are right but I won't hold my breath. Under Biden/Harris no one can guess what tomorrow brings! August is but 10 days away and then we all turn into felons if we own an AR Pistol. I'd like to wait until after August but I know these firearms will not be available for very long - Hell - I've waited 6 months and can only find 3 available now!

    Assuming that you already own an AR15 rifle.
    If you buy only the shorty upper ... you could be considered in Constructive Possession of a SBR.

    If you buy the shorty upper, make sure you have:
    a lower that has never been sold/registered as a rifle in your possession at the same time.
    If you have a lower that was sold as a pistol or firearm.

    The key here is having that short barrel and only rifle lowers .. Not saying that the feds are going to bust in on ya, but if they ever do come to visit for a legit purpose or you get narced on ... that's an add on charge that isn't going to get dropped during negotiations with the prosecutor.

    Shorty barrels are cool, just not in 223/5.56 or 308.
    Shortys are cool on things like carbines that fire 9mm, 45acp, 300blackout, 5.7x28, 10mm, 12ga shotgun, especially doubles.

    What law are yours guys talking about taking effect August 1st? There is no AWB yet, and the ATF is supposed to hold off it's "Brace" ruling till December, it at all!

    Buy whatever you want ,, tell the commie ba$tards to eat $hit if they come knocking ,, tell them their loony toon resident in chief cannot write a law that supersedes your constitution ,,, and that their safety at the moment relies on their desire to uphold our constitution .

    I haven't received any notice about any law or EO for anything firearm related taking effect on Aug 1st 2022. Now Kali's new state laws took effect July 1st IIRC but that's Kali. On Aug24th the new ruling regarding the so called Ghost Guns goes into effect unless blocked by a Judgement of some court. The new AWB bill did clear the house, but has yet to be reviewed and brought to a vote by the senate.

    I wonder if what you are referring to is when the ATF dropped their first proposal in December 2020...yeah, that happened when a bunch of Senator started complaining.

    This is off the ATF website: Factoring Criteria for Firearms with Attached “Stabilizing Braces” | Bureau of Alcohol, Tobacco, Firearms and Explosives (atf.gov)
    "On June 7, 2021, the Attorney General signed ATF proposed rule 2021R-08, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces,’” amending ATF’s regulations to clarify when a rifle is “intended to be fired from the shoulder.”"

    So, it has been signed and is going forward and I have TRIED to find information about when is the current effective date but no-joy. So, if you have something then please let us know because as far as I can tell and last heard is August is the effective date. I sure want to believe it's December but can find nothing. Everybody is acting like it won't happen but it's been proposed, signed, and the comment period has ended and they sure as hell haven't dropped this version.

    "According to the Federal Register (Vol. 87, No. 20), the ATF has set tentative dates to finalize two proposed rulings with potential to significantly impact FFLs and gun owners. The rulings are related to the “Definition of ‘Frame or Receiver’ and Identification of Firearms” and “Factoring Criteria for Firearms With an Attached Stabilizing Brace,” with final action expected in June and August 2022, respectively. The comment period for both proposed rulings ended roughly six months ago."

    Last I heard they "temporary ceased production due to unforeseen circumstances" about 2 years ago.
    But if anyone knows of an AR upper that takes P90 mags let us know.

    They got a TON of comments and serious pushback this time so they pushed their effective date back until December of 2022!

    Part of this is the recent SCOTUS ruling which puts the ATF in the cross hairs, and part because it's an election year with a very tight margin, AND, a new director who knows he is going to face the fire that's coming, including a corrupt Attorney General!

    Check out "Armed Scholar" on U-Tube, as well as "Langley Outdoors Academy" both are most excellent for current up to the min 2nd content!
