§ 195 Generally

The general rule is that an unconstitutional statute, whether federal or state, though having the form and name of law, is in reality no law(1) but is wholly void(2) and ineffective for any purpose.(3) Since unconstitutionality dates from the time of its enactment and not merely from the date of the decision so branding it,(4) an unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed(5) and never existed;(6) that is, it is void ab initio.(7) Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.(8)

Since an unconstitutional law is void, it follows that generally the statute imposes no duties,(9) confers no rights,(10) creates no office(11) or liabilities,(12) bestows no power or authority on anyone,(13) affords no protection,(14) is incapable of creating any rights or obligations,(15) does not allow for the granting of any relief,(16) and justifies no acts performed under it.(17)

Once a statute is determined to be unconstitutional, no private citizen or division of the state may take any further action pursuant to its provisions.(18) A contract that rests on an unconstitutional statute creates no obligation to be impaired by subsequent legislation.(19) No one is bound to obey an unconstitutional law,(20) and no courts are bound to enforce it.(21) A law contrary to the United States Constitution may not be enforced.(22) Once a statute has been declared unconstitutional, courts thereafter have no jurisdiction over alleged violations.(23) Persons convicted and fined under a statute subsequently held unconstitutional may recover the fines paid.(24)

 

before too long. 16-20 years, only ones that will have semi auto firearms will be Police, military, people with security clearances, members of celebrity protection details and criminals.

And about 10 years after that .. well you will be allowed to have bolt actions, shot guns and revolvers but they will have to be checked out from the security locker at the range.

So time to start investigating rail guns and pulsed laser rifles.

 

What will be interesting will be how Potus and or Scotus respond to this blatantly unconstitutional proposed law.. If the bill is bundled up with something Potus really wants and he doesn't veto it? Well, that would and should provide the impetus for movement to freedom.. Photo's of all the horrors of socialist regimes should be displayed every where..

As a after thought, who will benefit from this sort of proposal? I am for free enterprise and taking advantage of opportunities, however, I will be considering who pumped the prices up verses a modest increase when I go to spend my hard earned FRN's..

That's all nice wording about unconstitutional laws being null and void. Tell that to all those that have been or are in jail for violating NFA 34. 85 years of being null and void except that it's still enforced with a vengeance gives a lie to pretty words.

 

Next budget, 5 billion for the wall and amendment to NFA all semi autos with 180 days to register existing.

The war about the second amendment continues with the left. Anyone hear about serial numbers on ammo in Illinois? I figured ammo would be what they would go after. Then what? Make Americans who don't give up semi-autos into criminals? I think it is a sign about SHTF maybe coming. There are so many potential black swan events waiting to happen.

 

Curious thought.. Just what approach will the lib's take in enforcing this proposed law? Will it be one of attrition as in the slow road.? Pick up a violator here and there with the media slanting the news painting the offender as a danger to all.. The dead never can speak the truth to counter the propogandized news. A slow, mostly unnoticed, increase in dead gun owners..??

Or, a massed, coordinated assault on gun owners homes at 0400 in selected areas of the country, leaving terrorized families, neighbour's and dead pets in its wake.. I do not think they will take this path.. Socialist accustomed to taking a slow path to attaining their goals. Original NFA was passed in 1934.. The first prosecution was in 1938 (?) in the Miller case.. The slow road!

More than likely, a declared national emergency due to a man hunt of some scapegoat group everyone stay in their homes, the government will search and remove contraband. They'll have to change tactics on occasion like maybe a national disaster everyone through the cattle shoot, fire arms plucked from them in confined spaces for 'Safety' of all.

then cut food and power .. you want it .. again through the cattle shoot.

Eventually they'll have confiscated enough to just go door to door taking what they want.

I watched that Boston bombing movie. Disgusted with people just letting cops run over them. I tried to imagine myself in the same situation. After having a big fat cop scream at me the other day I don't think it will be a win situation whatever people do.

 

On the other hand four people tied up almost 2,000 assorted LEOs and their equipment. Multiply those 4 by 1% of the population. Just a thought.

 

I'm compelled to write letters to the bills sponsors. Sending them the text of the Second Amendment seems like the best option, but it doesn't give me the hook I need.

I guess I could claim that I'm the "other" that "folks" are "othering" and keep my arms to defend myself and my other family. OOH! How about the fact that I was born with four fingers on each hand.

When writing to people who think islands will capsize, that they are "native Americans" because an ancestor had high cheek bones, and that President Trump is "dog whistling" some racist message that only they can hear, this just might work.

 

I think if you added the IQ's of all 535 members of Congress you might make double digits. Maybe not, AOC has to be in negative territory by quite a bit.
