Federal court rules police can shoot a dog if it moves or barks when officers enter a home Cops can execute your dog as a opener to their raid. What could go wrong?
Looks like the only dog that will be safe for police will be a dog that has already visited a taxidermist.....they don't tend to bark or move, and won't draw LEO gunfire, causing collateral damage to other premises occupants. Don't bet on it. When a 3 year old gets a flash/bang grenade in the crib, the stuffed dog is likely to get machinegunned. Remember the feds have already machinedgunned a house because the woman who just moved in didn't answer a late night knock and that enraged our little sociopath with a machinegun.
Did you hear about the one where they shot a caged dog? Plus I have found that most dogs just really dislike police.
Honestly for all the hubbub about dogs being shot during raid, etc... 90+% are legitimate shooting ( I can't find exact numbers) What is being discussed is the exception. yes there have been cases where LEO have mistakenly shot dogs/pets however the majority of the times during a drug bust etc. the dogs tend to be trained to attack first and not question the legality of the raid. This law protects the LEO's and should be looked at positively... YMMV...
They shot a dog in a fenced in back yard close to me recently. They were looking for a guy that jumped out and ran during a traffic stop, and when they attempted to enter the back yard and the dog started acting aggressively, they shot and killed it. Obviously the bad guy didn't go in that back yard and was found several streets away. The very PO'd homeowner is suing.... Just one more little thing they deem to be "OK" that wasn't a few years ago.
Ah yes, the "legitimate shooting" of dogs. In the small town 8 miles away the po-lice cheep climbed over the six foot chain link fence in the back yard and shot the family dog in front of the children while they were playing. He claimed he "did not know a SIX FOOT HIGH CHAIN LINK FENCE was a fence"! So what did he think it was?! Guess that one was not one of the 90+ "legit" dog shootings. I could list several other "not legit" dog shooting I personally know of, but why bother?
I have a funny feeling that there were some words missing from that quote. Too bad there's no way to cross check it.
Is chasing any perp probable cause to enter your home? I have guard dog signs posted. You know... dog may bite. Does this mean it's ok to come shoot my dogs of they are chasing someone? If "I didn't know..... " becomes a reason for police to not be in control of themselves then perhaps we don't need police. Or Maybe when they run thru my yard, shoot my dog I can shoot back and say "I didn't know it wasn't an iintruder"
Preface with I like most dogs more than most people and my little brother is a cop. 1. Did they find any drugs in the house? 2. Owner / resident offered to unlock the front door ??? We are not talking a no knock search here. 3. Argument that drugs/evidence could be destroyed during any delay is not valid in my mind. Way to easy to plug a sewer line to collect evidence. Sounds to me like the Cops had an axe to grind. I am all for law and order but what happened to "serve and protect"? A shinny badge should not be a pass to get away with murder and maiming people, kids and dogs and destroying private property. How many of us would act aggressively if someone kicked in the front door unannounced? whynot
I have 5 dogs and they all "move, bark and may act aggressive" to an intruder. By the time someone gets in my house and takes out all five dogs.... they will have a fury unleashed on them, like they prayed would not happen while they were outside.
The point of the law is in the " execution of a legitimate search warrant" not the chasing of a perp into your home... If the perp jumps your fence and your dogs attack him (while a case could be made to let the dogs have the perp), the officer is required to protect the perp and then shoot the dog.... In my opinion is there is a great deal of generalizing as to all cops being bad / dishonest/ etc on the forum by various individuals... this is their right... but... they are also the ones that yell the loudest when some individual with a gun kills some one and the libs speak out for gun control... there is a lot of Knee jerk reaction... and generalizations about how all gun owners/ guns are evil... You don't have to agree with my points but regardless of your opinions they are just as valid as your comments... as I stated earlier YMMV! I'm out of this thread.... enjoy
