On one's property, you would think that rain, dirt, sunshine, wind, flora/fauna fall under the category of "inalienable right." To put another way, those things are "inalienable rights" in the sense that they could not be surrendered by citizens to the sovereign. I don't know what's worse, a politicians who think they are smarter than everybody else and "know better"; or, the dumba$$ idots that vote for them. Next, you won't be able to use solar panels or put up a wind mill.
Ha that's funny. They'd love for property owners to do that here as they've begun collecting a very substantial tax on properties with large paved areas or enormous warehouse roofs as they say it contributes to flooding problems.
This is not so unusual... In Alaska, any water that you collect, BEFORE it hits the Ground is YOURS. Once it hits the Ground, it is Property of the State, PERIOD. You can apply for a Water Right, for the use of such water, and once Granted, it is Tied to your Property Deed. In Utah Water Rights are ALL tied Up, Period. So if you want Water and have no Water Right, you must BUY that water from someone who has a Water Right, and the State then issues you a Water Right for the amount that you purchased, and deducts that amount from the Person's Water Right, that sold you some Water. Water Rights are a State Issue and vary State to State. I am familiar with Alaska, and Utah, but not other States. There is awhole Law Structure concerning Water Rights in MANY States. If you need to know, consult you State Statutes......... Y State MV.....

Worldwide I am such an Outlaw on so many levels. Here at home in my comfort zone not so many. Truth is there are so many laws out there that are unconstitutional and make so little sense in the real world, that most of us are lawbreakers with out even knowing it. This is one reason I avoid crowds, cities, and have no desire to live in town or even a sub division. I have real acreage and I am surrounded by lots and lots of trees and understory. I bother no one, and do not want to be bothered. I ask little of government except to be left to my own pursuits. Each day I take another small step towards self sufficiency.
Next it will be air being owned i can see it now any air you've inhaled belongs to you but the next breath is owned by the state...

I'd say that if we had a "real" supreme court we could take it there as denying us our property without due process.
This is the kind of stuff that inspires me to expedite plans on exponentially increasing the capacity of my rainwater capture system.
The role of the SC now is not the way the Framers intended it. The were actually concerned with the exact thing we have now...a SC that usurps the power of the states. Think about it...one or two more liberal justices and we're screwed for 20+ years (e.g., Roe v Wade). As it is now, once they have ruled...that's it. But i would proceed quietly just in case they decide to make rain water harvesting illegal. Colorado is another state with rain water legislation. Ergo, we didn't buy any 'Retirement' property there.
